Caretaker Authorization Affidavit Opt-Out
California’s Assembly Bill 495 took effect on January 1, 2026. This law expands who may act as a child’s temporary caregiver and who can present a caregiver’s authorization affidavit to schools and medical providers, without direct parental consent.
Many parents and families are now seeking ways to formally assert their parental rights and clarify their expectations with their children’s schools. Advocates for Faith & Freedom has prepared a Caretaker Authorization Affidavit Opt-Out Notice to equip parents with a clear, practical way to assert their constitutional rights and to place schools and officials on formal notice that parental consent is required before any third party may assume care, custody, or decision-making authority over their child.
This form is a practical tool for parents who want to ensure that:
-
Your directions to the school about your child’s care and custody are documented in writing.
-
Only you and your authorized emergency contacts may act on your child’s behalf.
-
There is no confusion or misinterpretation about your parental authority under current law.
This resource exists to help parents proactively safeguard their children and stand firmly in their God-given role as their first and primary protectors.
